Welcome to Prenta.ph! These Creator Terms of Use outline the guidelines and expectations for content creators who contribute their designs to our platform. By engaging with Prenta.ph's services, you enter into a binding agreement to abide by these terms. Introduction
Prenta.ph aims to provide a collaborative and innovative space for content creators to showcase their designs and connect with a broader audience. These terms are designed to establish a clear understanding between Prenta.ph and content creators, fostering a cooperative environment where creativity can thrive.
I. Acceptance of Terms
By utilizing prenta.ph’s services, you are agreeing to these terms and conditions. We reserve the right to modify these terms at any time; therefore, please review them frequently. Changes and clarifications will take effect immediately upon their posting on the website. The platform reserves the right to change the terms and conditions at any time, and users will be notified of these changes through email.
II. Content and Intellectual Property Rights
You retain sole ownership of your assets. Prenta.ph is only permitted to sell your designs as prints on products we sell on the website and other sales channels.
For content creators whose designs were made by our in-house artists, ownership will be shared. We cannot sell it without your permission, and you cannot use the design outside prenta.ph unless you have an agreement to buy and take control of the asset from prenta.ph.
You represent and warrant that you own or are the licensee of all trademark rights, copyrights, rights of publicity, and other intellectual property or other proprietary rights necessary to create and implement the listing.
III. Content Guidelines
Prenta.ph values the authenticity of human creativity and does not accept AI-generated art. We also prohibit content that infringes on the rights of others or violates our community standards.
Prenta.ph does not accept Trademark and Copyrighted Assets, usually in forms of fan arts and reproductions based on famous elements such as, but not limited to, movie actors, anime characters, KPOP idols, and other assets found on the internet. All assets used should be original and/or have proper permission from the owner. We reserve the right to delist your products if they do not adhere to these rules. It is your responsibility to ensure your art does not contain any infringing elements.
IV. Pricing, Taxes, and Payments
You have the flexibility to set the price for your products. Nevertheless, please note that currently, we are not obligated to collect VAT from customers, given our status as a new business. You will be informed once we reach the VAT threshold, at which point we will commence adding taxes to the prices of the shirts.
Your commission will be paid out monthly, at the conclusion of each month, based on the payment details you provide us. It's important to be aware that certain payments may experience delays due to various reasons, such as shipping issues, Cash-on-Delivery (COD) collections, or returns. In such instances, any pending payments will be excluded from the current month's payout and included in the subsequent month's payment if successfully collected.
V. Discounts and Site-wide Promotions
As a creator on Prenta.ph, you have the ability to offer discounts on your products. This allows you to engage with your audience and boost sales through personalized promotions. You can set this on your information sheet by utilizing “Compare - at price”.
Prenta.ph may initiate site-wide promotions to drive traffic and increase sales across the platform. During such events, your products may be featured or promoted to a broader audience. It's important to note that the discount applied during site-wide promotions will be distributed proportionately between the production cost and the commission of the creator. This ensures a fair and balanced impact on both the platform and the content creators.
VI. Use of Assets and Products for Promotion and Marketing
By participating as a content creator on prenta.ph, you acknowledge and grant Prenta.ph the right to use your assets and products for promotional, listing, and marketing purposes. This includes, but is not limited to, featuring your designs in social media posts, online promotions, and marketing campaigns directly related to Prenta.ph, both on the website and across various social media platforms.
You retain ownership of your intellectual property; however, you grant Prenta.ph a non-exclusive, worldwide, royalty-free license to use, reproduce, and display your assets and product images solely for the purpose of promoting, listing, and marketing your products on the Prenta.ph website and official social media accounts.
Prenta.ph will make reasonable efforts to credit you as the creator of the showcased designs whenever possible. If you have specific guidelines or restrictions regarding the use of your assets for promotional, listing, or marketing purposes, please communicate them to Prenta.ph in writing.
VII. Shipping, Packaging, and Returns
Shipping and Packaging will be handled by Prenta.ph. We will facilitate the return and refund process for your customers, ensuring the best experience for your supporters.
VIII. Termination of Agreement
Should you choose to discontinue selling your products, we will swiftly remove all listings from the website and cease selling them. Additionally, all your assets will be deleted from our database, ensuring the secure protection of your art and data.
IX. Dispute Resolution
In the event of a dispute between the platform and the artist, we will strive for a fair and timely resolution. We encourage open communication and direct negotiation between parties as the first step towards resolving conflicts. If a resolution cannot be reached, we will terminate service and agreements.
X. Indemnification Clause
By using Prenta.ph, you agree to indemnify and hold harmless prenta.ph and its employees from any claims or damages that arise from your use of the service.
XI. Warranties and Liabilities
Prenta.ph provides the platform and services "as is" and does not make any warranties or representations regarding the platform, the services, or the products. Our liability for issues that might arise is limited to the extent permitted by law.
